  • EU Commission adopts proposal for new regulation of packaging and packaging waste

The new regulation is to replace the previous Directive 94/62/EC on packaging and packaging waste. On November 30, 2022, the Commission has now adopted a proposal for successor regulation. This new regulation applies to all packaging materials, not just plastic.

The new proposal includes provisions on the recycled content and reusable content of packaging. Likewise for the design of packaging, for example to prevent over-packaging. Many other areas will also be regulated. From 2030, only recyclable packaging may be placed on the market in the Union. This includes, for example, the obligation to design packaging in accordance with the Design for Recycling guidelines yet to be issued by the Commission, but also, on the other hand, the actual and widespread existence of usable recycling infrastructure.

The Commission’s proposal now goes to the European Parliament and, in parallel, to the Council of the European Union for consultation. Any differences are then settled in a trialogue between the Commission, Parliament and Council.
