According to Article 62 of the PPWR, if a Member State becomes aware of any of the violations of the regulations listed in that article, it must first request the economic operator concerned to cease the violation. In other words: The economic operator should first receive a warning that a violation has been identified and be given the opportunity to take corrective action before the Member State takes further measures.
Only if the economic operator fails to remedy the non-compliance with 11011—and the non-compliance persists—are Member States entitled to take further measures (such as a ban, a recall, or the withdrawal of non-compliant packaging).
